Wabash Man Faces Multiple Charges After Wild Run-In With Police Saturday Night

WABASH,Indiana – A 40-year-old Wabash man who pleaded guilty in 2009 to Operating While Intoxicated and in 2012 for Possession of Meth and Unlawful Possession of a Syringe is sitting in the Wabash County Jail in big trouble once again. Jose Delgado Jr., who resides on the 200-block of Elm Street, is facing two counts of a Resisting Law Enforcement as a Level 6 felony, two counts of Battery on a Police Officer as a Level 6 felony and one count of Disorderly Conduct after a run-in with police on Saturday night.

Police were called to the parking lot of the Holiday Inn Express on Cass Street at approximately 7:55 Saturday evening after the manager received a call from a guest that a man was looking into car windows. According to a Probable Cause Affidavit written by Wabash City Police Patrolman Andrew Johnson, the man, identified as Delgado, was extremely agitated and ranting about a conspiracy by the federal government. Johnson’s affidavit also states that Delgado was talking to the clouds and a distant cell phone tower before making a statement about hitting an officer. Another affidavit says that the man was raising his voice and using profanity towards law enforcement.

Attempts to get Delgado to calm down failed and, according to another affidavit by Sheriff’s Department Sergeant Steven Hicks, officers took the man “down to the ground” after he called attention to but refused to show police exactly what was in his clinched fist. The affidavit by Hicks then notes that he felt a pain in his right wrist during the melee that ensued which turned out to be a bite put on by Delgado. After extracting the man from Hicks’ wrist, the authorities placed him in the back of a patrol car where Hicks alleges Delgado said “I’ll see you in hell!”

While Sergeant Hicks wasn’t hurt, Patrolman Johnson was and he received four stitches to his chin after the incident at Parkview Wabash Hospital.

When arriving at the Wabash County Jail, Delgado’s comments to Sergeant Hicks allegedly became serious threats. According to Hicks’ affidavit, Delgado said that he wanted Hicks alone in the drunk tank so that he could “take care of him.” Hicks also alleges that Delgado threatened to “beat [his] ass.” After other profane insults, the affidavit states that Hicks took the totality of the verbal taunts as a serious threat to his safety. Delgado is still in jail on a $10,000 personal appearance bond and is apparently still being extremely aggressive towards officers. In fact, the mug shot you see above is from a previous arrest because, according to the Sheriff’s Department, the jail not not been able to take a new one due to Delgado’s aggressive nature.
