Dyson Pleading With Indiana Supreme Court Against Wabash County Clerk Dismissed

INDIANAPOLIS,Indiana – Less than 24 hours after Doug-Alan [Dyson] filed a Writ of Mandamus with the Indiana Supreme Court wanting that high court to order Wabash County Clerk Elaine Martin to identify whether there are vacancies on the non-existent common-law court in Wabash County so that an special election can be held to fill those seats, Indiana Supreme Court Chief Justice Loretta Rush ruled on the writ filed by Alan [Dyson] on Thursday.

Chief Justice Rush said that the pleadings are procedurally deficient, but, nevertheless, she decided to rule on the merit of his pleading. In dismissing the action, Justice Rush said that the writ seeks a remedy that is not appropriate under law and ruled that a petition for a rehearing or on motions to reconsider are not allowed.

County Clerk Elaine Martin said that she was confident that the court would dismiss the pleading but she is surprised at how little time it took to do so.
