Peru Firefighter terminated for possession of marijuana and smoking devices in home is pushing back against decision

PERU, IN — A Peru firefighter who was terminated, after police say they found marijuana and smoking devices at his house, is pushing back against the decision. Scott West, 38, was arrested April 10 and was put on a paid leave of absence from the Peru Fire Department until May 19. The Peru Board of Works then voted to terminate his employment on June 1. West then filed a request for an appeals hearing to challenge the decision, and later accused the city of not properly providing him with written notice about when the hearing would take place. State code requires that if a board holds a hearing, written notice must be given either by service upon the member in person or by a copy left at the member’s residence at least 14 days before the date set for the hearing. In a letter to the board of works, West said the appeal date was set for July 9, but the notice was sent by certified mail, which he didn’t receive until July 2, thus not meeting the 14-day requirement. City attorney Dustin Kern said the issue has now been set to be discussed at the next meeting of the Peru Board of Works Aug. 7, and a deal between the city and West might be voted upon at the meeting. He is scheduled for an informal pretrial conference Aug. 30 in Miami County Superior Court II. A bench trial is scheduled for Sept. 13.
