Fountainvue LLC responds to Town of LaFontaine’s unjust threats to water and sewer services


LAFONTAINE, IN- Fountainvue LLC has announced that they have
responded to and addressed all issues raised by the Town of LaFontaine regarding
water and sewer services provided to the Fountainvue Community. Despite this,
the Town has issued a threat to cut off services to tenants who have been
punctually paying their bills, unless Fountainvue LLC submits to demands never
agreed upon.
In 1989, the Town of LaFontaine pledged to supply water and sewer services to
Fountainvue Community residents. The Town has been providing these services
and billing the tenants monthly, as per the agreement. The agreement stipulated
that the underground water and sewer lines were the property of the landlord. The
Town, under this agreement, could advise the property owner to perform
maintenance on these lines.
Fountainvue LLC promptly addressed the Town’s maintenance advisories of
October 16, 2020, and December 20, 2023, by submitting detailed work schedules
and plans of action. The issues raised in 2020 were completed by November 30,

  1. By January 31, 2024, all but two issues in the 2023 letter had been
    resolved, with the remaining two being attended to by an independent contractor
    and have since been completed.
    Michael Cummins, Managing Member of Fountainvue LLC, stated, “We have
    diligently addressed every issue raised by the Town in an effort to provide our
    community with uninterrupted water and sewer services. Unfortunately, the Town
    has not acknowledged our efforts and is threatening our tenants.”
    In 2017, the Town filed an unrelated lawsuit against Fountainvue LLC. An
    agreement was signed by all parties on February 10, 2022, which the Town has
    yet to honor by dismissing the lawsuit and collaborating with Fountainvue LLC to
    develop the property. The Town’s attorney may have misrepresented facts to the
    court by claiming that the agreement was signed in 2021, while it was not
    actually finalized until February, 2022.
    Fountainvue LLC was not directly informed about the Town’s intentions to
    disconnect water services. Instead, a letter was sent to Fountainvue LLC’s
    attorney accusing the company of not adhering to the 1989 agreement – an
    allegation that contradicts Fountainvue LLC’s compliance with maintenance
    requests by January 31, 2024.
    Mr. Cummins added, “We remain committed to our community and will continue
    to uphold our end of the agreement. We urge the Town to do the same and not
    penalize our residents who have been paying their bills regularly.”
