Drug Overdose Leads To Arrest For Child Pornography

AKRON — While responding to a drug overdose, officers discovered evidence of child pornography, including images of children under 12 years old and images of bestiality.

Andrew James Mitterling, 26, 8719 West CR 1250S, Akron, is being charged with possession of methamphetamine, possession of a narcotic drug and possession of child pornography, all level 6 felonies.

On March 23, officers with the Kosciusko County Sheriff’s Department responded to a drug overdose in Akron. Upon arrival, EMTs were treating the overdose victim, identified as Mitterling, in the bathroom of the residence. In the bathroom, officers discovered a plastic bag containing .08 grams of methamphetamine, a plastic bag containing .02 grams of heroin and a metal spoon with residue on it.

Mitterling admitted to officers that he had been using drugs for around two weeks before the overdose. He had purchased the heroin and methamphetamine that led to his overdose on March 20.

Officers confiscated Mitterling’s phone as evidence and obtained consent to search the phone.

According to the affidavit of probable cause, officers discovered multiple inappropriate photographs on the cell phone. The photographs included images of sexual misconduct by children who appeared to be less than 18 years old, images of bestiality and images of children who appeared to be less than 12 years old. A sexual type message about a 9-year-old female was also discovered on the phone.

Mitterling was booked into the Kosciusko County Jail on May 17 with a $10,250 surety and cash bond.
