Update to Accidental Shooting in Marion

UPDATE: The autopsy findings revealed that victim Annalysa McMillan was struck by a single gunshot to the area of her back. Austin Smith, who was in possession of the assault style rifle was seated in the driver side-rear passenger seat at the time the rifle (.223 caliber) discharged. The projectile entered and exited the driver’s seat and struck Annalysa in her back. The cause of death is ruled: Gunshot Wound to the Back, and the manner of death is ruled a Homicide. Vehicle passengers Arial Williams, age 19 and Dakota Enyeart, age 18 were not injured.

On November 26, 2019 at 5:52 pm, the Marion Police Department responded to a report of an Accident with Injury at Mason Blvd/Baldwin Ave. Officers arrived on scene and discovered that the driver of one of the vehicles was unresponsive. Officers immediately began resuscitation efforts until Marion General Hospital personnel arrived. During the investigation it was discovered that one round from an AR15 style rifle had been discharged from inside the vehicle, prior to the crash, striking the driver. The shooting of the driver caused a minor accident with another vehicle.

The driver of the vehicle was transported to Marion General Hospital where she was pronounced dead. The victim has been identified as Annalysa Nikole McMillan, age 19 of Gas City Indiana.

Austin Mark Smith, age 22 of Marion Indiana, has been preliminarily charged with Criminal Recklessness with a Deadly Weapon, Level 6 Felony and Reckless Homicide, Level 5 Felony.
